TERMS OF SERVICE – CHAR DHAM & DO DHAM

GENERAL TERMS & CONDITIONS

1. Currency
All prices, fees and charges are quoted in Indian Rupees (INR) unless expressly stated otherwise.

2. Acceptance of Terms
By making a reservation, the guest and/or channel partner acknowledges that they have read, understood and unconditionally agreed to be bound by the Terms and Conditions, policies and operational guidelines of Thumby Aviation, as amended from time to time.

3. Disagreement with Terms
If the guest or channel partner does not agree with any of the stated terms and conditions, Thumby Aviation shall not be obligated to proceed with or confirm the booking.

4. Right to Cancel or Modify Reservations
Thumby Aviation reserves the absolute right to cancel, suspend, reject or modify any reservation suspected to be fraudulent, unauthorized or in violation of applicable laws or aviation regulations.

5. Limitation of Obligation
Thumby Aviation’s obligations are limited strictly to the services confirmed in writing and are subject to regulatory approvals, operational feasibility, safety considerations and force majeure conditions.


PAYMENT POLICY

1. Advance Payment
A non-refundable advance payment of 50% of the total booking value is required at the time of booking.

2. Balance Payment
The remaining 50% must be paid on or before the cut-off date communicated by Thumby Aviation.

3. Delayed Payments
Delayed or non-payment may result in cancellation, and the advance amount may be forfeited without further notice.

4. Release of Unconfirmed Bookings
Unconfirmed bookings may be released or cancelled without additional communication.

Payments must be made only to the official bank account of Thumby Aviation Pvt. Ltd. Payments made to personal or third-party accounts will not be the responsibility of Thumby Aviation.

GST & INVOICE POLICY

1. GST Submission
Valid GSTIN and billing address must be provided at the time of booking to claim ITC.

2. Invoice Finality
Invoices will not be amended if GST details are not submitted prior to issuance.


DATA PRIVACY & CONSENT

By proceeding with a booking, guests consent to the collection and use of their personal data for operational, compliance, internal analysis and marketing purposes in accordance with applicable laws.


OFFER CONFIDENTIALITY POLICY

1. Confidential Nature
All special rates or offers are confidential and intended solely for the recipient.

2. Non-Disclosure
Sharing Thumby Aviation’s commercial terms with third parties will result in immediate withdrawal of the offer.


IDENTITY & CHECK-IN REQUIREMENTS

1. Mandatory Identification
Guests must carry a valid original government-issued photo ID.

2. Accepted IDs
Indian Nationals: Aadhaar Card or Passport
Foreign Nationals: Valid Passport with Visa


AGE & MINOR POLICY
  • Children aged 2 years and above are treated as adults.
  • Infants below 2 years and under 10 kg may travel free on a parent’s lap.
  • Infants above 10 kg require a full ticket.
  • All minors must be accompanied by an adult.

MEDICAL ADVISORY

Guests must be medically fit for high-altitude travel. Those with pre-existing medical conditions are advised to obtain medical clearance. Thumby Aviation bears no liability for medical issues arising during travel. No refunds apply for medical cancellations.

Charter Limits
Maximum passengers: 6
Passenger weight limit: 420 kg
Baggage limit: 30 kg
Combined limit: 450 kg

Individual Allowance
Passenger: 70 kg
Baggage: 5 kg


CANCELLATION & REFUND POLICY
  • More than 60 days prior: Full refund
  • 30–59 days prior: 50% refund
  • Less than 30 days or No-show: No refund
  • Refunds processed within 60 days of approval

FORCE MAJEURE

Thumby Aviation shall not be liable for delays or cancellations caused by natural disasters, regulatory restrictions, weather conditions, VVIP movements, NOTAMs or other circumstances beyond control.


DISPUTE RESOLUTION & JURISDICTION

All disputes shall be governed by the laws of India and subject to the exclusive jurisdiction of courts in Delhi.

• If there is any disagreement with the stated terms, please note that we will not be able to proceed with the booking confirmation.
• Thumby Aviation reserves the right to cancel or modify reservations suspected to be fraudulent or inappropriate.

PAYMENT POLICY
• A 50% advance payment is required at the time of booking to confirm the reservation.
• The remaining 50% must be settled on or before the specified cut-off date.
• Kindly note, delayed payments may lead to cancellation of the booking, and the advance paid may be retained without prior notice.
• Thumby Aviation reserves the right to release unconfirmed bookings without further communication.

For your safety and to maintain financial integrity, please do not make any payments to personal accounts or individuals claiming to represent Thumby Aviation. GST & INVOICE POLICY
• For claiming input tax credit, guests must provide their company’s valid GSTIN number and official billing address at the time of booking.
• Thumby Aviation will not revise invoices at a later stage if GST details are not provided upfront.

OFFER CONFIDENTIALITY POLICY
• Any special rates or inclusions extended to a guest/client are strictly confidential and must not be disclosed to third parties.
• While guests are free to explore alternate quotations from other Operators or Agents, sharing or disclosing Thumby Aviation’s offer with others will lead to immediate withdrawal of the offer.

DATA PRIVACY CONSENT
By proceeding with a booking through Thumby Aviation, guests provide their consent for the use of their personal information (including sensitive data) for administrative purposes, internal research and marketing activities, in accordance with applicable data protection regulations.

IDENTITY & CHECK-IN REQUIREMENTS
• All guests are required to carry and present a valid original photo ID at the time of check-in and boarding.
• Provide a valid ID proof as mentioned Aadhaar Card (or Passport and Visa for foreign nationals). Indian Nationals: Aadhar Card or Passport Foreign Nationals: Valid Passport along with Visa

AGE & MINOR POLICY
• Children aged 2 years and above will be treated as adults for fare purposes.
• Infants below 2 years of age and weighing under 10 kgs may travel free of charge, seated on the lap of a parent. No separate seat will be provided.
• If the infant weighs above 10 kgs, they will be considered an adult for fare purposes, and a full ticket will be required.
• Our services are designed for adult passengers; minors (under 18 years) must be accompanied and supervised by an adult at all times.

GUEST RESPONSIBILITY
To help ensure smooth and efficient operations, guests are kindly requested to:
• Submit accurate body weight details at the time of booking.
• Settle any applicable overweight charges in advance to avoid boarding issues.
• Share complete arrival and departure information (flight or train tickets) is mandatory.
• Pack belongings in a soft, lightweight duffle bag not exceeding 5 kg.

MEDICAL ADVISORY
• Travel to high-altitude destinations requires guests to be in good physical health.
• Guests with medical conditions such as high/low blood pressure, heart ailments, diabetes, asthma, lung disorders or any other condition that may be affected by altitude are strongly advised to obtain a medical clearance certificate from their doctor prior to travel, for their own safety.
• Guests are solely responsible for their health and well-being during the journey. Thumby Aviation shall not be held liable for any medical complications or eventualities arising during the course of travel.
• In the event of a cancellation due to medical reasons, please note that no refund will be applicable.

HOTEL ACCOMMODATION & MEAL ADVISORY
• Confirmed hotels are subject to change in the event of unforeseen circumstances, particularly weather-related delays that may prevent guest check-outs. In such cases, alternative accommodations of a similar category will be provided. Thumby Aviation reserves full rights to make these changes as necessary.
• Thumby Aviation may alter hotel arrangements at the point of flight origin or destination, depending on room availability.
• For groups of six or more passengers, accommodations may be split across different hotels, as guests may travel in separate helicopters due to body weight limitations.
• In the event that breakfast or any meal is missed due to flying schedules or unforeseen circumstances, guests are kindly requested to be prepared for such eventualities. Please note that meals are arranged as per the standard schedules of the respective hotels and may not always align with individual flight timings.

OCCUPANCY POLICY (ACCOMMODATION)
• Accommodation is arranged on a double or triple sharing basis.
• Guests requesting single occupancy will incur an additional charge as follows:
– INR 50,000 + GST for Char Dham
– INR 30,000 + GST for Do Dham

LUGGAGE & WEIGHT POLICY
At Thumby Aviation, your safety and comfort are our top priorities. In line with aviation safety regulations and aircraft limitations, we kindly request guests to review and adhere to the following luggage and weight policies:

Permissible Charter Weight Limits
• Charter seating capacity: 6 passengers
• Maximum passenger weight limit: 420 kg
• Maximum baggage weight limit: 30 kg
• Combined allowable limit (passengers + baggage): 450 kg

Individual Passenger Allowance
• Passenger weight allowance: 70 kg per person
• Baggage allowance: 5 kg per person
• Passenger body weight and luggage will be verified prior to boarding each flight sector for safety compliance.

CABIN BAGGAGE GUIDELINES
• Each guest will be provided with one soft-shell, compact duffel bag (maximum 5 kg) by Thumby Aviation upon arrival.
• Hard-shell suitcases, trolleys or oversized luggage are strictly not permitted.
• Guests are requested to pack light and travel with minimal essentials in accordance with aviation safety norms.

BAGGAGE TRANSFER VIA ROAD
• Baggage exceeding the 5 kg per person limit will not be permitted onboard and must be transported separately by road at the guest’s own expense.
• Road transfer of excess luggage is available at an additional cost and must be paid in full in advance.
• The designated vehicle will make stops only at Gangotri (Harshil/Jhala) and Phata. Please note that there will be no stops at Yamunotri (Kharshali), Kedarnath Top or Badrinath.
• Guests are advised to plan accordingly, as any delays in luggage delivery due to unforeseen circumstances are beyond Thumby Aviation’s control and must be accommodated by the guest.
• The transfer service is optional and undertaken at the guest’s own discretion and risk. Thumby Aviation will not be liable for any delays, damage or loss of valuables during the road transport of baggage.

SHARED CHARTER vs. FULL CHARTER – WEIGHT POLICY
Full Charter (6 Seats Booked by a Single Party):
If the entire charter is booked by one group, the total permissible passenger weight of 420 kg will be considered collectively. This allows some flexibility among group members, as long as the combined passenger weight remains within the overall limit.
Shared Charter (Mixed Group Bookings):
In shared charters, each passenger is individually restricted to a 70 kg body weight and 5 kg baggage allowance. No pooling or redistribution of weight allowances is permitted under this arrangement.

OVERWEIGHT MANAGEMENT
To ensure flight safety and optimal weight distribution, the following options are available for managing passenger weight exceeding the permissible limits:
Option 1: Purchase of Additional Seat(s)
• Guests may choose to purchase an extra seat (or seats) at a 10% discount on the prevailing seat fare, to manage excess weight without reshuffling or deboarding family members.
• An additional cabin baggage allowance will be permitted in line with the vacant seat(s) purchased for weight adjustment.
Option 2: Pay Overweight Charges
• Guests exceeding the 70 kg per person limit (excluding baggage) will be subject to additional weight charges as follows:
Char Dham Yatra: ₹2,500 per kg
Do Dham Yatra: ₹2,000 per kg
All overweight charges must be fully paid prior to departure.
• Thumby Aviation reserves the right to adjust the passenger manifest including seating, grouping, reshuffling or reassigning guests to different flights or boarding sequences, based on actual weights and in accordance with flight safety and balance protocols.
• Reshuffling, deboarding, or rescheduling may occur to manage excess weight, and in such cases, Thumby Aviation will not be liable for any hotel accommodation or related expenses, which will be the sole responsibility of the guest.

WEIGHT DECLARATION
• Guests are required to provide their accurate body weight at the time of booking. Final weight will be verified at each sector using calibrated digital weighing machines.
• In the event that the actual weight exceeds the declared weight by more than 2 kilograms, the operator reserves the right to deny boarding without any refund.
• No refund shall be applicable in such cases, and the decision of the operator will be final and binding.

PRE- FLIGHT LOBBY REPORTING GUIDELINES
• Guests are required to be present in the hotel lobby at least an hour and a half before the assigned departure time.
• Late reporting may lead to missed charter, and Thumby Aviation will not be held responsible for any such instances.
• No refund or credit will be issued to guests or channel partners if the guest misses their charter due to delayed reporting.

FLYING SCHEDULE
• The sequence of Dham visits may be altered due to unfavourable weather conditions or other unforeseen circumstances. Such changes will be made at the sole discretion of Thumby Aviation, based on operational feasibility.
• Departure timings and the overall flight schedule are subject to change without prior notice.
• Itinerary adjustments may be made at the discretion of Thumby Aviation, including covering multiple Dhams within a shorter time frame, depending on operational feasibility and prevailing conditions.

SUGGESTED BUFFER TIME – FOR RETURN PLANNING
As Thumby Aviation operates under a Non-Scheduled Operator Permit (NSOP), flight operations are subject to change based on weather or operational constraints. We strongly recommend keeping a two-day buffer when planning your return travel to accommodate any potential delays.
In the event there are no delays, guests can make the most of the buffer days by exploring nearby destinations such as Haridwar, Rishikesh, or Mussoorie.

TAXI SERVICES & ROAD TRANSFERS AT VARIOUS DHAM/SECTORS
• Airport Pick Up Taxi / Railway Station Pick Up services are arranged on a shared basis, generally accommodating up to 3 guests per vehicle, depending on arrival and departure timings.
• For transfers at the respective Dhams, transportation for a group of 6 (one charter) passengers will be arranged using 2 vehicles.
• Guests requesting exclusive (non-shared) taxi services will be required to bear the full cost of the vehicle directly.

DARSHAN & SPECIAL POOJA
• Priority darshan assistance will be arranged at Yamunotri and Gangotri.
• VIP darshan is included at Kedarnath and Badrinath.
• VIP darshan facilitates expedited temple entry, but does not ensure exclusive access.
• All darshan arrangements will be conducted in compliance with government SOPs.
• Special poojas such as Shyan Aarti, Maha Abhishek, Rudra Abhishek or any special offerings are not part of the package.
• Guests interested in performing special poojas may submit a request; however, confirmation will be provided only 24 hours prior to the scheduled pooja and is strictly subject to availability.
• In case of any revisions in darshan or pooja fees by temple authorities, Thumby Aviation will not bear the difference. Guests are kindly advised to be prepared to pay any additional charges, in accordance with the updated rates as determined by the respective temple authorities.

KEDARNATH TOP STAY ADVISORY
Thumby Aviation shall not be held responsible for any emergencies, service disruptions, or challenges experienced during the stay at Kedarnath Top.

SIGHTSEEING ADVISORY
At Thumby Aviation, our foremost priority is providing you with a smooth and fulfilling Darshan experience at all the Dhams. While we strive to include visits to additional scenic or significant sites, these depend on weather conditions, time availability, and operational considerations. In certain situations, we may alter, shorten or cancel the sightseeing portion of the itinerary to maintain safety, punctuality and overall trip quality. We truly appreciate your understanding and cooperation.

SHUTTLE SERVICE
Thumby Aviation operates shuttle services strictly within the time slots allocated by UCADA to the respective operators. As per UCADA directives, we also cater to passengers holding IRCTC issued shuttle tickets. The sequence of boarding and departure for charter and shuttle passengers is managed at the discretion of Thumby Aviation to ensure safe and efficient operations. All services are subject to weather conditions, regulatory permissions and unforeseen operational circumstances. We sincerely request your kind understanding and cooperation.

DONATIONS & ADDITIONAL EXPENSES
Expenses such as donations, tips, porter services, palki/pony charges (except at Yamunotri) are not included in the package and must be borne directly by the passengers.

SAFETY & PROHIBITED ITEMS
• Passengers are strictly prohibited from carrying hazardous items including weapons, flammable substances, intoxicants, and similar materials.
• Boarding may be denied—without refund—in cases of intoxication, abusive behaviour, or if the passenger is deemed unfit to travel due to health or safety concerns.

CANCELLATION POLICY & REFUND POLICY
• Cancellations made more than 60 days prior to the travel date will be eligible for a full refund.
• Cancellations made between 30 to 59 days before the travel date will be eligible for a 50% refund (50% retention applicable).
• Cancellations made less than 30 days before the travel date, or in case of a no-show, will not be eligible for any refund (100% retention applicable).
• Approved refunds will be processed within 60 days from the date the cancellation and refund request is formally accepted.

FORCE MAJEURE
Thumby Aviation shall not be liable for any delays, disruptions, or cancellations arising from circumstances beyond its control, including but not limited to:
• Natural disasters, acts of God, war, civil unrest
• Regulatory restrictions, pandemics, labour disruptions
• Orders from DGCA, AAI, or local authorities
• Delayed air traffic clearances or permissions
• VVIP movements and NOTAMs

FLIGHT DISRUPTIONS & ASSOCIATED EXPENSES & REFUNDS
• Flight disruptions may occur due to uncontrollable circumstances such as natural disasters, acts of God, war, civil unrest, regulatory restrictions, pandemics, labour strikes, directives from DGCA, AAI, or other local authorities, delayed air traffic clearances or permissions, VVIP movements, and NOTAMs. In such events, any additional overnight stays or related expenses will be borne by the
guest. Thumby Aviation will not be held liable for these costs.
• If the disruption is due to technical issues with the aircraft or illness of the flying crew, Thumby Aviation will bear the cost of overnight accommodation and meals as per the applicable food plan.
• Backlog & Flight Disruption: If Thumby Aviation is unable to operate the scheduled service on the confirmed date due to a backlog caused by delays on previous days (owing to weather, technical issues, or operational constraints), the company will provide accommodation with all meals at the affected sector. However, Thumby Aviation will not be responsible for rescheduling or reimbursing any flight or rail tickets impacted by the delay.
• No Flying: Thumby Aviation reserves the right to cancel the charter due to adverse weather conditions or operational challenges. In such instances, refunds will be issued after deducting applicable expenses already incurred, including costs for airport transfers, hotel accommodations and a 10% fee towards flight preparation charges.

DISPUTE RESOLUTION
All disputes shall be governed by the laws of India and will be under the jurisdiction of courts in
Delhi.

GRIEVANCE REDRESSAL & OPEN DOOR POLICY
• All grievances related to services will be addressed with sensitivity and
confidentiality. Guests may freely share feedback or concerns with Thumby’s leadership.
• All grievances will be handled with confidentiality and sensitivity.
• Feedback will be used to improve future service quality.
